By completing a rental request and signing the NICE1 Patient Rental Agreement, you agree to:
Rental pricing varies based on rental duration, delivery method, and referral source. All pricing will be confirmed in writing before your rental is finalized.
Late Fees: Equipment not returned within 5 days of the rental end date will be charged $100 per week until returned.
Extensions: Available upon request. Must be confirmed before the rental end date. Subject to additional fees.
Taxes: Rental fees may be subject to city and/or state taxes for durable medical equipment.
Summit Med Tech offers in-person delivery for local customers and ground or overnight shipping for customers outside the local area. We are not responsible for delays caused by shipping carriers or circumstances outside our control.
You are responsible for maintaining the equipment in good working condition. You will be responsible for the cost of repair or replacement of equipment that is damaged, lost, or stolen while in your care. The Spears Co. LLC d/b/a Summit Med Tech shall not be responsible for loss or damage to your property while the equipment is in your custody.
Summit Med Tech provides equipment rental and logistics services only. We do not provide medical advice, diagnosis, or treatment.
Always follow the instructions from your surgeon, physician, or healthcare provider. Their guidance takes precedence over any general instructions we provide. If you experience pain, numbness, or any adverse reaction, discontinue use and contact your healthcare provider immediately.
To the maximum extent permitted by law, The Spears Co. LLC d/b/a Summit Med Tech shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the total amount paid by you for the rental period in question.
You agree to indemnify and hold harmless The Spears Co. LLC d/b/a Summit Med Tech, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the equipment or violation of these Terms.
These Terms shall be governed by the laws of the State of Alabama. Any disputes shall be resolved in the courts of Alabama.
